Dust Deals Terms & Conditions
These promotional terms apply specifically to the Dust Deals promotion (the “Promotion”) and should be read alongside our standard Terms & Conditions of Sale, which continue to apply except where expressly varied below.
References to “you” mean the purchaser and “we”, “us” or “our” mean Dust Arrest, a trading name of Addex Group Ltd.
1. The offer
- Dust Deals offers up to 30% off selected products while promotional stock lasts.
- The discount varies by product. The promotional price and, where applicable, the saving will be clearly shown on the relevant product page.
- The Promotion applies only to products specifically identified as part of Dust Deals.
- Products which are not identified as Dust Deals products are sold at their normal price and are subject to our standard Terms & Conditions.
2. Limited promotional stock
Dust Deals is a limited-stock promotion.
Promotional prices apply only while the stock allocated to the Promotion remains available and the Promotion may therefore end for an individual product before any advertised closing date.
Promotional stock is allocated on a first-come, first-served basis.
Adding an item to your basket or submitting an order does not reserve promotional stock.
An order is accepted when we send you our Order Confirmation, in accordance with our standard Terms & Conditions.
If promotional stock is no longer available before we accept your order, we will let you know and refund any payment already taken.
Once the promotional allocation of a product has sold out, we are not obliged to restock it or make further stock available at the promotional price.
3. Promotional prices
The Dust Deals price shown for each participating product is the promotional price applicable to that product.
Where we show a percentage saving or comparison with another price, that saving will be calculated using the comparison price identified for that product.
No further promotional code, trade discount or other price reduction may be applied to a Dust Deals price unless we expressly state otherwise.
For Consumers, prices will be presented in accordance with the pricing information provided on our website, including VAT and unavoidable charges where required by law.
Standard delivery charges apply unless a separate delivery offer is expressly stated.
4. Pricing or website errors
We take reasonable care to ensure that Dust Deals prices, product descriptions and availability are accurate.
If an obvious pricing, description or availability error is identified before we accept your order, we may decline the affected order and will refund any payment already taken.
The formation of a contract and acceptance of an order are governed by our standard Terms & Conditions of Sale.
5. Availability and fulfilment
Because promotional quantities are limited, availability may change quickly.
If a Dust Deals item becomes unavailable before we accept an order, we may offer you:
- a full refund;
- an alternative product, if you wish; or
- the opportunity to purchase the product later at the price then applicable.
You are under no obligation to accept an alternative product or purchase at the normal price.
We do not offer rain checks, retrospective promotional pricing or guaranteed back-orders for sold-out Dust Deals stock unless we expressly agree otherwise.
6. Trade accounts
Dust Deals orders made through a trade account remain subject to the normal credit status, credit limit and payment terms applying to that account.
We may decline a new order before acceptance if there are overdue amounts, an exceeded credit limit or a material breach of the agreed trading terms.
7. Returns, cancellations and made-to-order goods
Our standard returns, cancellation and faulty-goods provisions continue to apply to Dust Deals purchases.
For Consumers buying online or by telephone, the normal statutory 14-day cancellation right applies where applicable.
Where a Dust Deals product is made to the customer's specifications, personalised, customised or specially manufactured to that customer's individual requirements, the statutory 14-day cancellation right may not apply, as set out in our standard Terms & Conditions of Sale.
If a Dust Deals product is returned and a refund is due, the refund will be based on the price actually paid for that product, rather than its normal or non-promotional price.
Purchasing an item during a sale or promotion does not reduce a Consumer's statutory rights in relation to faulty, misdescribed or non-conforming goods.
8. Changes to the Promotion
We may amend, suspend or end the Promotion where reasonably necessary, including where:
- promotional stock has been exhausted;
- a material pricing or technical error has occurred;
- circumstances outside our reasonable control affect our ability to operate the Promotion; or
- continuing the Promotion would result in a legal or regulatory issue.
Any change will not affect an order that we have already accepted except where permitted by law or by our standard Terms & Conditions.
9. General
Product images are for illustrative purposes and minor non-material differences in packaging or appearance may occur.
Our standard Terms & Conditions of Sale continue to apply except where these promotional terms expressly provide otherwise.
Nothing in these promotional terms excludes, restricts or affects any statutory rights which cannot lawfully be excluded or restricted.
These promotional terms are governed by English law in accordance with the governing-law provisions contained in our standard Terms & Conditions.
