Terms & Conditions
These Terms & Conditions apply to purchases made from Dust Arrest, a trading name of Addex Group Ltd.
We have tried to keep these terms clear and straightforward. Please read them before placing an order, as they contain important information about the basis on which we supply goods to you.
References to “you” or “your” mean the person or business purchasing the goods. References to “we”, “us” or “our” mean Addex Group Ltd trading as Dust Arrest.
For the purposes of these terms:
- a Consumer is an individual purchasing goods wholly or mainly for purposes outside their trade, business, craft or profession; and
- a Business Customer is anyone purchasing goods wholly or mainly for business purposes.
Certain provisions below apply differently depending on whether you are a Consumer or a Business Customer.

2. Placing an order
You can correct any input errors during the online ordering process before submitting your order.
Once you submit an order, you will receive an Order Reference Number and an email acknowledging that we have received your order.
The acknowledgement of your order does not mean that we have accepted it.
We will then send you an Order Confirmation email. A contract between you and us is formed when we send that Order Confirmation.
We may decline an order before sending an Order Confirmation, including where:
- the goods are unavailable;
- there has been an obvious pricing or product-description error;
- payment has not been authorised;
- applicable credit terms have not been met;
- we reasonably suspect fraud or unauthorised activity; or
- we are unable to supply the goods for legal or regulatory reasons.
If we decline an order after payment has been taken, we will refund the amount paid.
For telephone orders where no email address is available, we will confirm acceptance of the order by another appropriate means.
3. Product information
We take reasonable care to ensure that product descriptions, specifications, images, availability and other information on our website are accurate.
Product images are for illustrative purposes. Packaging, colour and other minor non-material details may occasionally vary from those shown.
Any technical information, measurements or specifications are subject to normal manufacturing tolerances unless we expressly state otherwise.
Nothing in these terms affects our legal obligation to supply goods that conform to the contract.
4. Prices and payment
Prices are shown in pounds sterling (£GBP).
The price payable will be the price displayed or otherwise agreed when you place your order, subject to correction of any obvious error before we accept the order.
For Consumers, the total price payable, including VAT and any other unavoidable charges where applicable, will be made clear before the order is submitted.
Delivery charges, where applicable, will be shown before you submit your order.
For Business Customers, prices may be shown exclusive of VAT where this is clearly stated. VAT will then be charged at the applicable rate.
Payment is normally taken when an order is submitted unless you have an approved trade account or we have agreed different payment terms with you.
We may carry out reasonable payment, identity and fraud-prevention checks before accepting or fulfilling an order.
5. Trade accounts
Where goods are purchased using a trade account, the order is also subject to the credit limit and payment terms agreed for that account.
We may suspend further supplies or decline new orders where:
- invoices are overdue;
- an agreed credit limit has been exceeded; or
- there has been a material breach of the agreed trading terms.
Any separate written terms agreed specifically with a Business Customer will take precedence over these website terms to the extent of any inconsistency.
6. Delivery
We aim to dispatch and deliver stock items promptly and will provide an estimated delivery timescale where possible.
Any delivery date or timescale given is an estimate unless we expressly agree that it is guaranteed.
We will not be responsible for delays caused by events outside our reasonable control, but if a significant delay occurs we will contact you as soon as reasonably practicable.
For Consumers, the goods remain at our risk until they are delivered to you or to a person identified by you to receive them.
For Business Customers, risk in the goods passes on delivery.
Special or expedited delivery may be available at additional cost.
7. Missing, damaged or incorrect deliveries
Please inspect your delivery as soon as reasonably practicable.
If goods are missing, incorrect or visibly damaged in transit, please contact us promptly on 0800 980 0105 or at sales@dustarrest.com.
Where possible, we ask that visible transit damage is reported within 48 hours, as this assists us in dealing with the carrier.
For Consumers, failure to notify us within 48 hours does not affect your statutory rights.
8. Change-of-mind returns
Our voluntary 14-day returns policy
If you change your mind, we are normally happy to accept a return within 14 days of delivery, provided that the goods are unused, complete and, where reasonably possible, returned in their original packaging together with any accessories or promotional items supplied with them.
This voluntary returns policy is separate from, and does not restrict, the additional statutory rights Consumers have when purchasing at a distance.
Please contact us before returning goods so that we can provide appropriate return instructions.
Consumer cancellation rights
If you are a Consumer purchasing online or by telephone, you normally have the legal right to cancel your contract within 14 days after the day on which you receive the goods, without giving a reason.
You must tell us clearly that you wish to cancel within that 14-day period.
After notifying us that you wish to cancel, you normally have a further 14 days to return the goods.
You may inspect and handle the goods as you would reasonably be able to do in a shop. If you handle the goods beyond what is reasonably necessary to establish their nature, characteristics and functioning, we may be entitled to make an appropriate deduction from the refund to reflect any reduction in value.
9. Made-to-order, bespoke and personalised goods
Some products are manufactured, modified, configured or otherwise produced specifically to a customer's individual requirements.
Where goods are made to your specifications, clearly personalised, customised or specially manufactured for you, the statutory 14-day cancellation right for Consumers will not normally apply.
This may include, for example:
- products manufactured to non-standard dimensions, specification or configuration requested by you;
- products modified or adapted specifically for you;
- personalised or branded products; and
- other goods which we have expressly identified before purchase as being specially manufactured to your individual requirements.
Where this exclusion applies, we will make this clear before the order is placed wherever reasonably practicable.
This does not affect your statutory rights where the goods are faulty, misdescribed or otherwise do not conform to the contract.
For the avoidance of doubt, a standard product does not become non-returnable merely because it is manufactured or assembled after an order is placed. The exclusion applies where the goods are genuinely made or adapted to your individual specification or requirements.
10. Other exclusions from consumer cancellation rights
The statutory cancellation right may also not apply to goods which:
- are liable to deteriorate or expire rapidly;
- are sealed for health protection or hygiene reasons and have been unsealed after delivery, where the statutory exception applies; or
- fall within another statutory exception to the cancellation right.
11. Refunds following consumer cancellation
Where a Consumer validly cancels an order under their statutory cancellation right, we will refund:
- the price paid for the goods; and
- the cost of our standard delivery service.
If you selected a more expensive delivery service, we are not required to refund the additional amount above the cost of our standard delivery option.
Unless we have agreed to collect the goods, you are responsible for returning them to us and for the direct cost of doing so, unless we state otherwise.
We may withhold the refund until we have received the goods back or you provide evidence that you have returned them, whichever occurs first.
Refunds will be made using the original payment method unless otherwise agreed.
12. Faulty, damaged or misdescribed goods — Consumers
If you are a Consumer, the goods we supply must be:
- of satisfactory quality;
- fit for any particular purpose made known to us where the law requires;
- as described; and
- otherwise compliant with your statutory rights.
If goods do not conform to the contract, you have legal remedies under the Consumer Rights Act 2015.
This includes, where applicable, a 30-day short-term right to reject faulty or non-conforming goods and obtain a refund.
After the initial 30-day period, you may be entitled to a repair or replacement and, in appropriate circumstances, a price reduction or final right to reject.
Any manufacturer's warranty or guarantee we provide is additional to these statutory rights and does not replace or reduce them.
You do not need to return genuinely faulty goods in unused or “as new” condition in order to exercise your statutory rights.
We may inspect goods to establish the nature and cause of an alleged fault.
We are not responsible for faults caused by misuse, accidental damage, failure to follow operating or maintenance instructions, unauthorised modification or normal wear and tear.
13. Faulty goods — Business Customers
Business Customers should notify us promptly after becoming aware of an alleged defect.
We may inspect the goods and, where a valid claim is established, we will at our option repair or replace the goods or refund the price paid, subject to the liability provisions below and any separate warranty applicable to the product.
We are not responsible for faults arising from misuse, accidental damage, neglect, improper installation or maintenance, unauthorised modification or normal wear and tear.
Nothing in this section excludes any rights which cannot lawfully be excluded.

Please provide your Order Reference Number and sufficient details for us to identify the purchase.
Where reasonably possible, please return goods securely packaged and with the accessories, instructions and other items originally supplied.
Where proof of purchase is reasonably required, we may ask you to provide it. This does not prevent a Consumer establishing their purchase by another reasonable means.
15. Manufacturer repairs and warranties
Some products may be repaired by an authorised manufacturer or specialist service centre.
Where appropriate, we may arrange for the manufacturer or an authorised repair agent to inspect or repair the product.
Any manufacturer's guarantee is provided in addition to, and does not affect, a Consumer's statutory rights against us as the retailer.
16. Liability to Consumers
Nothing in these terms excludes or limits any liability which it would be unlawful for us to exclude or limit, including liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or your statutory rights relating to the goods.
If you are a Consumer, we are responsible for losses which are a foreseeable consequence of our breach of the contract or our failure to use reasonable care and skill.
We are not responsible for losses that were not reasonably foreseeable when the contract was formed.
We supply goods to Consumers for private use. If you use goods for a commercial, business or resale purpose, our liability to you will be dealt with under the provisions applying to Business Customers.
17. Liability to Business Customers
This section applies only where you are a Business Customer.
Nothing in these terms excludes or limits our liability for:
- death or personal injury caused by our negligence;
- fraud or fraudulent misrepresentation; or
- any other liability which cannot lawfully be excluded or limited.
Subject to the above, we will not be liable for any:
- loss of profit;
- loss of revenue or turnover;
- loss of business;
- loss of anticipated savings;
- loss of goodwill;
- loss of opportunity; or
- indirect or consequential loss.
Subject to the above, our total aggregate liability arising out of or in connection with an order, whether in contract, tort (including negligence), breach of statutory duty or otherwise, will not exceed the total price paid or payable for the goods under that order.
These limitations apply only to the extent that they are reasonable and legally enforceable.
18. Title to goods — Business Customers
For Business Customers, ownership of goods will not pass to you until we have received payment in full for those goods.
Risk nevertheless passes in accordance with section 6 above.
Until ownership passes, you must take reasonable care of the goods and, so far as reasonably practicable, keep them identifiable as goods supplied by us.
19. Waste Electrical and Electronic Equipment
Electrical and electronic goods must be disposed of responsibly and in accordance with applicable WEEE legislation.
Where responsibility for treatment, recovery or disposal is lawfully transferred to a Business Customer under an applicable written agreement, that agreement will apply.
Nothing in these terms removes or restricts any statutory rights available to Consumers in relation to the disposal or take-back of electrical and electronic equipment.
20. Events outside our reasonable control
We will not be responsible for a failure or delay in performing our obligations where this is caused by circumstances outside our reasonable control.
These may include severe weather, transport disruption, industrial action, fire, flood, interruption of utilities, failure of telecommunications networks, acts of government, import or export restrictions or significant disruption within our supply chain.
Where such an event affects an accepted order, we will take reasonable steps to minimise the effect and will contact you where appropriate.
Nothing in this section affects a Consumer's statutory rights.
21. Website and intellectual property
We and/or our licensors own the copyright, trademarks and other intellectual property rights in the material and content appearing on this website.
You may view, download and print reasonable extracts for your own personal or internal business use.
You may not reproduce, republish, commercially exploit or distribute substantial parts of the website or its content without our prior written consent, except where permitted by law.
Links to third-party websites are provided for convenience only. We are not responsible for the content or operation of websites outside our control.
22. Personal information
We process personal information in accordance with our Privacy Policy.
Please refer to the Privacy Policy on our website for information about how and why we collect and use personal data and the rights available to you.
23. Promotions and special offers
From time to time we may offer promotions, discounts, competitions or other special offers.
Additional terms may apply to those offers. Where they do, they will be made available alongside the relevant promotion.
If promotional terms conflict with these Terms & Conditions, the specific promotional terms will apply only to the extent necessary to give effect to that promotion.
24. Changes to these terms
We may update these Terms & Conditions from time to time.
The terms applying to an order will be the version in force when the relevant contract is formed. We will not retrospectively change the terms of an existing contract simply by updating this website.
25. General
If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue in effect.
A failure or delay by us in exercising a right does not mean that we have waived that right.
Unless expressly stated otherwise, no person other than you and us has any right to enforce these terms.
26. Governing law and jurisdiction
If you are a Consumer, these terms and your contract with us are governed by English law. You may bring proceedings in the courts of England and Wales or, if applicable, the courts of the part of the United Kingdom in which you live.
If you are a Business Customer, these terms and any contract between us, together with any non-contractual obligations arising from them, are governed by English law and subject to the exclusive jurisdiction of the courts of England and Wales.
27. Your statutory rights
Nothing in these Terms & Conditions is intended to exclude, restrict or affect any statutory rights that cannot lawfully be excluded or restricted.
